Terms of Service

These Terms are the agreement between you and Pixetory for the use of Tile Feast. Please read them — in particular the sections on liability and on progress being stored only on your device.
1Agreement to these Terms
By downloading, installing, or playing Tile Feast (the Game), you agree to these Terms of Service. If you do not agree, do not use the Game and delete it from your device.
These Terms apply together with our Privacy Policy, which forms part of this agreement.
2Who may play
You must be at least 13 years old, or older if the minimum age of digital consent in your country is higher, to use the Game.
If you are under the age of majority where you live, you may use the Game only with the permission of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Game, including any purchases.
3Your licence
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and play one copy of the Game on Apple-branded devices that you own or control, for your own private, non-commercial entertainment.
This licence is also subject to Apple’s Licensed Application End User Licence Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and that agreement conflict, these Terms apply to the extent permitted.
We reserve every right not expressly granted to you.
4What you may not do
You agree not to:
- copy, sell, rent, sublicense, or otherwise distribute the Game or any part of it
- reverse engineer, decompile, or disassemble the Game, except to the extent that applicable law expressly permits it despite this restriction
- modify the Game, use cheats, memory editors, automation, bots, or emulators to gain an advantage, or play a modified or repackaged build
- extract, reuse, or republish the Game’s artwork, audio, level data, or other assets
- interfere with advertising, block ad requests in a way that still delivers rewards, or otherwise obtain in-game benefits you have not earned
- use the Game to break any law, or attempt to disrupt the services it depends on
5Your progress is stored on your device
The Game saves your progress locally. There is no account and no cloud backup.
This means that deleting the Game, resetting your device, or moving to a new device will permanently erase your progress, and we have no way to recover or restore it. We are not liable for lost progress, and we do not offer compensation for it.
6Advertising
The Game is free and supported by advertising, including advertisements you may choose to watch in exchange for an in-game reward.
Advertisements are supplied by third-party networks. We do not create them and do not control their content or the sites they link to. If you see an advertisement that is inappropriate, misleading, or broken, please tell us at support@pixetory.com with a screenshot and we will pass it to the network.
Interacting with an advertiser is a matter between you and that advertiser; we are not responsible for their products, services, or terms.
7In-app purchases
The Game does not currently offer in-app purchases. This section applies if and when it does.
All purchases are processed by Apple through your App Store account, and are subject to Apple’s terms. Virtual items and currency are licensed to you for use inside the Game — you do not own them, they have no monetary value, and they cannot be transferred, exchanged for cash, or redeemed outside the Game.
Consumable items are used up when used. Because purchases are made through the App Store, refunds are requested from Apple and are granted at Apple’s discretion under its policy; we cannot issue refunds directly. Nothing here limits any statutory right of withdrawal or refund you have as a consumer.
We may change prices, change what an item does for game-balance reasons, or stop offering an item. If we permanently discontinue the Game, unconsumed items may become unusable; where the law requires a remedy in that situation, we will provide it.
8Changes to the Game
We may update the Game, add or remove levels and features, adjust difficulty, change how rewards work, or discontinue the Game entirely, at any time and without individual notice.
We do not guarantee that the Game will always be available, or that it will remain compatible with future versions of iOS or with your particular device.
9Intellectual property
The Game — including its code, artwork, characters, tile designs, music, sound effects, level layouts, and text — is owned by us or our licensors and is protected by copyright and other laws. Pixetory and Tile Feast, and their logos, are our trademarks.
If you send us ideas, suggestions, or feedback about the Game, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use them for any purpose without any obligation or payment to you. Please do not send us ideas you consider confidential.
10Third-party services
The Game relies on services operated by others, including Apple’s App Store, AppLovin for advertising, and Google’s Firebase for analytics and crash reporting.
Your use of those services is governed by their own terms and privacy policies. We are not responsible for their acts or omissions, or for any interruption they cause.
11Termination
You may end this agreement at any time by deleting the Game from your devices.
We may suspend or end your licence immediately if you breach these Terms, in particular the restrictions in the section on what you may not do.
The sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive the end of this agreement.
12Disclaimers
The Game is provided as is and as available, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement.
We do not warrant that the Game will be uninterrupted, timely, secure, or free of errors, or that every level is solvable in every configuration, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here affects the statutory rights of consumers.
13Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, lost progress, or loss of goodwill, arising out of or relating to the Game, whether based on contract, tort, or any other theory, even if we have been advised of the possibility.
Our total liability for all claims relating to the Game is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars (US$50).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are unaffected.
14Indemnity
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense, including reasonable legal fees, arising from your misuse of the Game, your breach of these Terms, or your violation of any law or of the rights of a third party.
This does not apply to the extent the claim results from our own breach or negligence, and it does not apply where you are a consumer and applicable law does not permit it.
15Terms required by Apple
The following apply because the Game is distributed through the App Store:
- These Terms are between you and us only, not with Apple. Apple is not responsible for the Game or its content.
- Apple has no obligation to provide maintenance or support for the Game. All support requests should be sent to support@pixetory.com.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the Game. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
- We, not Apple, are responsible for addressing any claim relating to the Game, including product liability, failure to conform to a legal requirement, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for investigating and defending any claim that the Game infringes a third party’s intellectual property rights.
- You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-law rules, and any dispute will be brought in the courts of the Province of Ontario, Canada.
If you are a consumer resident in another country, this does not deprive you of the protection of the mandatory consumer law of your country of residence, and you may also bring proceedings in the courts there.
Before starting formal proceedings, please email support@pixetory.com describing the problem and allow us 30 days to resolve it. Most issues are settled this way.
17General
These Terms and the Privacy Policy are the entire agreement between us about the Game. If any provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
We may transfer these Terms to a successor if the Game or our business is transferred; you may not transfer yours without our consent.
We may change these Terms as the Game changes. The current version is always at this address, with the date at the top, and material changes will be flagged in the app before they take effect. Continuing to play after a change means you accept the updated Terms.
These Terms are published in several languages for convenience. If there is any discrepancy, the English version controls.
